Terms of Service
These Terms of Service ("Terms") govern your use of AI-EWS-WX, the AI Early Warning System for Weather, an emergency weather notification service operated by Gower Heritage Holdings, LLC ("GHH," "we," "us," or "our"). By subscribing to or using AI-EWS-WX, you agree to these Terms.
Important: AI-EWS-WX is an informational notification service. It is not a substitute for official emergency communications, NOAA Weather Radio, local emergency management instructions, or your own situational judgment. You are responsible for monitoring authoritative sources and taking appropriate action during severe weather.
1. The Service
AI-EWS-WX delivers severe weather alerts and forecast briefings to opted-in subscribers via email and SMS. Alerts are sourced from the National Weather Service (NWS) and the Storm Prediction Center (SPC), filtered for relevance to subscriber-monitored locations, and synthesized using automated analysis.
The Service includes:
- Severe weather alerts: Tornado Warnings, Severe Thunderstorm Warnings, Flash Flood Warnings, Winter Storm Warnings, and other NWS-issued advisories affecting your monitored locations.
- Forecast briefings: Periodic summaries of weather conditions and risk forecasts for your monitored locations, delivered by email.
- Subscriber portal: Self-service access to manage your alert preferences, monitored locations, and contact information.
2. Eligibility and Accounts
You must be at least 18 years old to subscribe. By subscribing, you represent that the information you provide is accurate and that you have the authority to authorize the contact methods you provide.
You are responsible for maintaining the confidentiality of any account credentials and for all activity under your subscription.
3. SMS Messaging Terms
If you opt in to SMS alerts:
- By providing your mobile number and checking the SMS consent box, you consent to receive automated SMS messages from AI-EWS-WX at the number provided.
- Message frequency varies based on weather conditions. Severe weather days may generate multiple messages; quiet weeks may generate none.
- Standard message and data rates from your mobile carrier may apply. AI-EWS-WX does not charge for messages, but your carrier may.
- Reply STOP to any message to cancel SMS alerts immediately. Reply HELP for assistance.
- SMS delivery is dependent on carrier network availability and is not guaranteed.
SMS opt-in is separate from email opt-in. You may unsubscribe from one channel without affecting the other.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Provide false, misleading, or fraudulent information when subscribing.
- Subscribe contact information that does not belong to you or for which you do not have authorization.
- Attempt to interfere with, disrupt, or gain unauthorized access to the Service or its underlying systems.
- Resell, sublicense, or redistribute the Service or its alerts without our express written consent.
5. No Warranty
The Service is provided "as is" and "as available." We do not guarantee that alerts will be timely, accurate, complete, or delivered. Weather forecasts and risk classifications are inherently uncertain. Delivery depends on third-party infrastructure including telecom carriers, internet providers, and weather data sources outside our control.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
6. Limitation of Liability
To the fullest extent permitted by law, GHH and its officers, employees, contractors, and partners shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to:
- Failure to receive an alert
- Delay in alert delivery
- Inaccuracy of weather information
- Property damage, personal injury, or loss of life
You acknowledge that during severe weather you must monitor authoritative sources (NOAA Weather Radio, local broadcast media, official emergency management) and take responsibility for your own safety decisions.
7. Termination
You may cancel your subscription at any time by:
- Replying STOP to any SMS alert (immediate)
- Clicking the unsubscribe link in any email
- Contacting support@myonlineciso.com
We may suspend or terminate your access to the Service at our discretion, with or without notice, if you violate these Terms or for any other reason.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, retain, and protect your information.
9. Changes to These Terms
We may revise these Terms from time to time. Material changes will be communicated by email to active subscribers at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Cherokee County, Oklahoma.
